Warranty&#xA0;</strong></p><p style="margin-left: 20px; line-height: 1;">a. KickAss guarantees its Products to be of acceptable quality in accordance with Section 54 of the Australian Consumer Law.&#xA0;</p><p style="margin-left: 20px; line-height: 1;">b. Subject to this policy, if a Product fails to be of acceptable quality during the Warranty Period due to a defect in material or workmanship, KickAss will either:</p></div><div><p style="margin-left: 40px;">i. repair the Product; or&#xA0;</p></div><div><p style="margin-left: 40px;">ii. replace the Product with the same or equivalent Product (with regard to function, specification and design); or&#xA0;</p></div><div><p style="margin-left: 40px;">iii. provide the Customer with a refund for the purchase price of that Product.</p></div><div><p style="margin-left: 20px;">c. The repair or replacement of a Product or part does not restart or extend the Warranty Period for the Product.&#xA0;</p></div><div><p style="margin-left: 20px;">d. KickAss may repair Products using refurbished parts provided KickAss is reasonably satisfied the parts are durable, will function and perform properly for the duration of the warranty period and are of equivalent or better condition when compared to existing components.&#xA0;</p></div><div><p style="margin-left: 20px;">e. If KickAss provides a refund or replacement Product, title to the refunded/replaced Product will pass to KickAss from the date the Product is delivered to KickAss.&#xA0;</p></div><div><p style="margin-left: 20px;">f. KickAss may, at their discretion, decline Warranty if proof of original purchase cannot be provided.&#xA0;</p><p style="margin-left: 20px;">g. The Warranty is non-transferrable.</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">h. Scope of Warranty&#xA0;</strong></p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">a. The Warranty does not cover a Product that, in the opinion of KickAss or an authorised independent assessor, has become of unacceptable quality due to:&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 40px; line-height: 1;">i. Improper use or operation of the Product(s);&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 40px; line-height: 1;">ii. Faulty or incorrect installation;&#xA0;</p></div></div><div><div><p style="margin-left: 40px; line-height: 1;">iii. Unauthorised disassembly, tampering, repairs or modifications;&#xA0;</p></div><div><p style="margin-left: 40px; line-height: 1;">iv. Mold, insects, animals, adverse weather, accidents or reasonable and expected wear and tear.</p><p style="margin-left: 20px; line-height: 1;">b. The Warranty does not apply if:&#xA0;</p></div><div><p style="margin-left: 40px; line-height: 1;">i. The Product has been on-sold by the customer; or&#xA0;</p></div><div><p style="margin-left: 40px; line-height: 1;">ii. The Product has been exported for use outside of Australia; or&#xA0;</p></div><div><p style="margin-left: 40px; line-height: 1;">iii. The Product has been used for commercial use by government organisations or commercial fleet applications.&#xA0;</p></div><div><p style="margin-left: 20px; line-height: 1;">c. The Warranty does not cover:&#xA0;</p></div><div><p style="margin-left: 40px; line-height: 1;">i. Costs, losses or charges:&#xA0;</p></div><div><p style="margin-left: 60px; line-height: 1;">1. Of removing or installing the product;&#xA0;</p></div><div><p style="margin-left: 60px; line-height: 1;">2. Directly or indirectly associated with the product failing to remain of acceptable quality.&#xA0;</p><p style="margin-left: 60px; line-height: 1;"><br></p></div><div><p style="line-height: 1;"><strong>3. How to make a Warranty Claim&#xA0;</strong></p></div><div><p style="margin-left: 20px; line-height: 1;">a. To make a Warranty Claim the Customer must:&#xA0;</p></div><div><p style="margin-left: 40px;">i. Visit supportportal.kickassproducts.com.au and submit a claim using the contact form associated with the Product.<a href="mailto:warranty@kickassproducts.com.au" rel="noreferrer noopener" style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; cursor: text; text-decoration: none; color: inherit;" target="_blank"></a></p></div><div><p style="margin-left: 20px;">b. Return shipping of the Product will be arranged, at the cost of KickAss (product exclusions apply), to a determined appropriate facility for the Product to be assessed.&#xA0;</p></div><div><p style="margin-left: 20px;">c. Once an assessment has been completed, KickAss will contact the Customer, provide the outcome of the assessment and what action will be taken.</p><p style="margin-left: 20px;">d. If no fault is found with the Product after assessment, shipping costs may be charged to the Customer or deducted from any exchanges or refunds.</p></div><div><p style="line-height: 1;">&#xA0;&#xA0;</p><span data-teams="true" id="isPasted"><p><strong>4. Technical Support and Third-Party Testing</strong></p><p style="margin-left: 20px;">a. Customers must contact KickAss Products directly for technical support and troubleshooting related to any warranty or product issues.</p><p style="margin-left: 20px;">b. KickAss will not be held responsible for any fees incurred from third-party testing, inspections, or repairs of KickAss Products unless explicitly directed or approved in writing by KickAss.</p><p style="margin-left: 20px;">c. If KickAss determines that the Product needs further assessment, KickAss will arrange for the Product to be returned to its designated testing facility. KickAss will cover the cost of shipping and workshop services for Products under warranty.</p><p style="margin-left: 20px;">d. KickAss will not reimburse any third-party testing or service fees associated with assessing its Products without prior written consent or instruction.</p></span>&#xA0;</div><div><p style="line-height: 1;"><strong>4. Australian Consumer Law</strong>&#xA0;</p></div><div><p style="margin-left: 20px; line-height: 1;">a. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.&#xA0;</p></div></div><div><div><p style="margin-left: 20px;">b. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">c. Definitions</strong>&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; clear: both; cursor: text; overflow: visible; position: relative; direction: ltr;"><p style="line-height: 1;">In this policy:&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">a. <em><strong>Australia Consumer Law</strong></em> means the Australian Consumer Law as set out from time to time in Schedule 2 of the Competition and Consumer Act 2010 (Cth);&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">b. <strong><em>Customer</em></strong> means a person who purchased a Product in Australia either directly from KickAss Products or from an Authorised Reseller;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">c. <strong><em>KickAss Products</em></strong> means KickAss Products Pty Ltd of 39 Iris Place, Acacia Ridge, QLD, 4220, Australia;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">d. <strong><em>Product</em></strong> means a product sold by Kickass Products;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">e. <strong><em>Purchase Price</em></strong> means the purchase price and cost of delivery for a Product;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">f. <strong><em>Warranty</em></strong> means the Warranty set out in this policy;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">g. <strong><em>Warranty Claim</em></strong> means a claim made by a Customer under the Warranty in accordance with Clause 3;&#xA0;</p></div><div style="-webkit-user-drag: none; -webkit-tap-highlight-color: transparent; margin: 0px; padding: 0px; user-select: text; position: relative;"><p style="margin-left: 20px; line-height: 1;">h. <strong><em>Warranty Period</em></strong> means the period commencing from the original date of purchase of a Product and ending after the identified period for that Product.</p></div></div>

Warranty Terms

A pro-rata warranty provides partial coverage for a product after the original replacement warranty period has expired.

<p id="isPasted">A pro-rata warranty provides partial coverage for a product after the original replacement warranty period has expired. The partial coverage is a credit value offer which is calculated based on the remaining time in the pro-rata period and the corresponding percentage of the original purchase price.</p><p>A 3-year + 2-year pro-rata warranty means the product comes with a 3-year (36-month) repair/replacement warranty period, followed by an additional 2-year (24-month) pro-rata warranty period.</p><p>Since the total coverage period is 5 years (60 months), a monthly value is calculated by dividing the original purchase price by 60. This monthly value is then multiplied by the number of remaining months within the coverage period to determine the available store credit.</p><p>&#xA7;If the product is found to be defective during the repair/replacement period, it will be repaired, replaced, or refunded.</p><p>&#xA7;If the defect is confirmed during the pro-rata period, a pro-rata value will be calculated and provided as store credit toward the purchase of a new product.</p><p>Example:</p><p>A product is purchased for $549 and is confirmed to have a defect after 41 months of use. The product&#x2019;s value per month is calculated as follows:</p><p>$549 &#xF7; 60 months = $9.15/month</p><p>Since there are 19 months remaining in the 60-month coverage period, the pro-rata value is calculated as:</p><p>$9.15 &#xD7; 19 = $173.85</p><p>The customer is entitled to a $173.85 credit, which can be used toward the purchase of a new product or issued as a standalone store credit. Since the pro rata period is an additional benefit beyond the standard limited warranty, the usual options for repair, replacement, or refund do not apply during these pro rata years.</p>
