KickAss Products Limited Warranty - Australia 

 

1. Warranty 

a. KickAss guarantees its Products to be of acceptable quality in accordance with Section 54 of the Australian Consumer Law. 

b. Subject to this policy, if a Product fails to be of acceptable quality during the Warranty Period due to a defect in material or workmanship, KickAss will either:

i. repair the Product; or 

ii. replace the Product with the same or equivalent Product (with regard to function, specification and design); or 

iii. provide the Customer with a refund for the purchase price of that Product.

c. The repair or replacement of a Product or part does not restart or extend the Warranty Period for the Product. 

d. KickAss may repair Products using refurbished parts provided KickAss is reasonably satisfied the parts are durable, will function and perform properly for the duration of the warranty period and are of equivalent or better condition when compared to existing components. 

e. If KickAss provides a refund or replacement Product, title to the refunded/replaced Product will pass to KickAss from the date the Product is delivered to KickAss. 

f. KickAss may, at their discretion, decline Warranty if proof of original purchase cannot be provided. 

g. The Warranty is non-transferrable. 

h. The benefits to you pursuant to this clause are in addition to the other rights and remedies you may have pursuant to applicable law. 

2. Scope of Warranty 

a. The Warranty does not cover a Product that, in the opinion of KickAss or an authorised independent assessor, has become of unacceptable quality due to: 

i. Improper use or operation of the Product(s); 

ii. Faulty or incorrect installation; 

iii. Unauthorised disassembly, tampering, repairs or modifications; 

iv. Mold, insects, animals, adverse weather, accidents or reasonable and expected wear and tear.

b. The Warranty does not apply if: 

i. The Product has been on-sold by the customer; or 

ii. The Product has been exported for use outside of Australia; or 

iii. The Product has been used for commercial use by government organisations or commercial fleet applications. 

c. The Warranty does not cover: 

i. Costs, losses or charges: 

1. Of removing or installing the product; 

2. Directly or indirectly associated with the product failing to remain of acceptable quality. 


3. How to make a Warranty Claim 

a. To make a Warranty Claim the Customer must: 

i. Visit supportportal.kickassproducts.com.au and submit a ticket using the contact form associated with the Product; or 

b. Return shipping of the Product will be arranged, at the cost of KickAss, to a determined appropriate facility for the Product to be assessed. 

c. Once an assessment has been completed, KickAss will contact the Customer, provide the outcome of the assessment and what action will be taken.

  

4. Australian Consumer Law 

a. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. 

b. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. 

c. You are also entitled to have the good repaired or replaced if the good fail to be of acceptable quality and the failure does not amount to a major failure. 

 

5. Definitions 

In this policy: 

a. Australia Consumer Law means the Australian Consumer Law as set out from time to time in Schedule 2 of the Competition and Consumer Act 2010 (Cth); 

b. Customer means a person who purchased a Product in Australia either directly from KickAss Products or from an Authorised Reseller; 

c. KickAss Products means KickAss Products Pty Ltd of 39 Iris Place, Acacia Ridge, QLD, 4220, Australia; 

d. Product means a product sold by Kickass Products; 

e. Purchase Price means the purchase price and cost of delivery for a Product; 

f. Warranty means the Warranty set out in this policy; 

g. Warranty Claim means a claim made by a Customer under the Warranty in accordance with Clause 3; 

h. Warranty Period means the period commencing from the original date of purchase of a Product and ending after the identified period for that Product.
